Terms of Use
These Terms of Use (“Terms”) are a legally binding agreement between you and the operator of the website located at https://gardengar.com (“GardenGar,” “we,” “us,” or “our”). They govern your access to and use of the GardenGar website and any related pages, newsletters, emails, RSS feeds, widgets, applications, and services we operate (collectively, the “Site”).
By accessing or using the Site, you agree to these Terms and to our Privacy Policy and Editorial Policies, which are incorporated by reference. If you do not agree, do not use the Site.
GardenGar publishes gardening, landscaping, houseplant, pest-control, yard-maintenance, and outdoor-living content. Nothing on the Site is a substitute for professional horticultural, landscaping, agronomic, arboricultural, veterinary, or medical advice, or for the instructions printed on any product label.
Who We Are
GardenGar is a digital gardening publication at gardengar.com. Our tagline is “Garden inspiration, from seed to bloom.” We publish how-to guides, plant care advice, small-space growing ideas, flower and houseplant coverage, landscaping techniques, pest-control methods, and coverage of yard tools and equipment.
GardenGar is the trading name of the operator of gardengar.com. If a named legal entity operates the Site, that entity is the contracting party under these Terms. The Site is operated from Pakistan and is offered to readers worldwide. For our current legal name and postal address, email staff@gardengar.com.
Questions about these Terms may be sent to staff@gardengar.com.
Eligibility and Intended Audience
The Site is intended for a general adult audience interested in gardening and plant care. You must be at least 18 years old, or the age of majority in your place of residence, to use the Site. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
The Site is not directed to children under 13, and we do not knowingly collect personal information from children. See our Privacy Policy for details.
You are responsible for complying with the laws of the place from which you access the Site, including laws about pesticide use, water restrictions, invasive plants, and home food production.
The GardenGar Service
We may offer articles, photos, illustrations, videos, newsletters, comments, search, product roundups, affiliate links, advertisements, and other features. We may change, suspend, or discontinue any part of the Site at any time, with or without notice, and without liability to you.
We do not promise that the Site will be uninterrupted, error-free, or available at any particular time. Maintenance, outages, and third-party failures may occur.
Access to the Site is currently provided without a paid subscription. We may introduce accounts, newsletters, contests, or paid features later. Additional terms will apply to those features if we do.
Informational Nature of Gardening Content
GardenGar content is provided for general information, education, and inspiration. Gardening results depend on climate, USDA or local hardiness zone, day length, soil, water quality, pests, cultivars, microclimates, and the gardener’s skill. What works in one garden may fail in another.
Plant names, hardiness ranges, sowing dates, watering schedules, fertilizer rates, companion-planting claims, and pest remedies on the Site are starting points, not guarantees. Always confirm plant identification, local frost dates, water-use rules, and product labels before you plant, prune, spray, or harvest.
We may consult master gardeners, designers, and other experts, and we work to keep coverage accurate. Even so, published information can become outdated as cultivars, regulations, and science change. You assume the risk of relying on any article, tip, photo, comment, or recommendation on the Site.
- Plant identification in photos can be incomplete or incorrect. Do not eat, brew, apply to skin, or give to animals any plant based solely on a GardenGar article or image.
- Yield estimates, “days to harvest,” and container-size suggestions are approximate.
- Regional advice (for example, growing tomatoes in 5-gallon buckets) may not transfer to your climate, water quality, or growing season.
- DIY tests (including jar soil tests) are informal and are not a substitute for a laboratory soil test or professional diagnosis.
Safety: Chemicals, Tools, Wildlife, and Toxic Plants
Many gardening activities involve physical risk. You are solely responsible for using tools, ladders, mowers, trimmers, tillers, irrigation, electricity, and chemicals safely.
Pesticides, fertilizers, and other products
If you use any pesticide, herbicide, fungicide, rodenticide, fertilizer, soil amendment, or household product, you must follow the manufacturer’s label. The label is the law in many jurisdictions. GardenGar descriptions of products or methods do not replace the label, local regulations, or licensed-applicator requirements.
Never mix chemicals unless the label allows it. Store products away from children, pets, and food. Dispose of containers as local rules require.
Toxic, allergenic, and invasive plants
Many ornamental, house, and edible plants are toxic to people, pets, or livestock if eaten, handled, or burned. Some cause skin or respiratory reactions. Some are legally restricted as invasive species. Confirm toxicity and legal status with authoritative local sources before planting or foraging.
Tools and outdoor work
Wear appropriate protection. Keep bystanders and pets clear of mowers and string trimmers. Call your local utility-location service before you dig. GardenGar is not responsible for injury, property damage, fire, flooding, or other harm arising from projects you undertake after reading the Site.
Edible Plants, Foraging, Food, and Health
Content about vegetables, herbs, fruit, mushrooms, foraging, preserving, compost, or garden-to-table cooking is not medical, nutritional, or food-safety advice. People who are pregnant, immunocompromised, or allergic, and households with small children or pets, should take extra care.
Do not treat GardenGar as a source of herbal medicine, essential-oil therapy, or veterinary treatment. Plants used as remedies can interact with medications and can be poisonous at common doses.
Home-preserved or home-grown food can carry pathogens if mishandled. Follow current food-safety guidance from public-health authorities, not solely a website article.
IF YOU HAVE A MEDICAL EMERGENCY, CALL YOUR LOCAL EMERGENCY NUMBER. IF YOU SUSPECT POISONING FROM A PLANT OR GARDEN CHEMICAL, CONTACT A POISON CONTROL CENTER OR EMERGENCY SERVICES IMMEDIATELY.
Intellectual Property
The Site and all content made available on it — including text, photographs, graphics, logos, page design, trademarks, video, audio, and software (the “GardenGar Content”) — are owned by GardenGar or its licensors and are protected by copyright, trademark, and other laws.
“GardenGar,” the GardenGar logo, and related marks are trademarks or trade dress of GardenGar. Third-party names, including plant cultivars, tool brands, and retailer names, are the property of their owners. Mention does not imply endorsement.
All rights not expressly granted in these Terms are reserved.
Limited License to You
We grant you a limited, revocable, non-exclusive, non-transferable license to access and display the Site and to print or download a reasonable number of articles for your personal, non-commercial, home-gardening use, provided you keep copyright and other notices intact.
You may not, without our prior written permission:
- Copy, scrape, crawl, or harvest the Site in bulk, including with bots, spiders, or AI-training crawlers that ignore robots.txt or that exceed ordinary browser use.
- Republish, syndicate, frame, mirror, or sell GardenGar Content, or use it to train, fine-tune, or ground a machine-learning or generative-AI system.
- Remove attribution, author bylines, or proprietary notices.
- Use our trademarks, award seals, or “as seen on GardenGar” style claims except as allowed by law or a written license.
- Circumvent access controls, rate limits, or security features.
Licensing and reuse of GardenGar Content is available only with our prior written permission. Email staff@gardengar.com with the subject line “Licensing” and describe the content, intended use, territory, and duration.
Short quotations for criticism, comment, news reporting, teaching, or scholarship may be permitted under applicable fair-use or fair-dealing law. That is not a license to copy articles in full.
User Conduct
You agree not to use the Site to:
- Violate any law, or infringe anyone’s intellectual-property, privacy, or publicity rights.
- Post malware, spam, scams, pyramid schemes, or deceptive affiliate schemes.
- Harass, threaten, defame, or discriminate against any person.
- Impersonate GardenGar, our editors, or any other person, including in hiring or “we will pay you to write” scams.
- Interfere with the Site’s operation, including by overloading, flooding, or reverse engineering except as allowed by law.
- Collect personal information about other users.
- Submit content that is pornographic, exploitative of minors, or that promotes illegal activity.
Comments, Tips, and Other User Submissions
If the Site allows comments, tips, photos, corrections, or other submissions (“User Content”), you retain ownership of your User Content. You grant GardenGar a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, edit, publish, translate, and display that User Content in connection with the Site and GardenGar’s publishing business.
You represent that you have all rights needed to grant that license, and that your User Content is accurate to the best of your knowledge and is not defamatory or unlawful.
We may refuse, edit, or remove User Content at any time. We do not undertake to monitor all User Content and are not liable for it. User tips are not GardenGar editorial content and are not fact-checked as articles are.
Do not submit confidential information. Unsolicited ideas for articles, products, or features may be used by GardenGar without compensation or acknowledgment, to the extent permitted by law. Please do not send ideas you wish to keep proprietary.
Copyright Complaints (DMCA)
If you believe content on the Site infringes your copyright, send a notice that satisfies the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) to staff@gardengar.com with the subject line “DMCA Notice,” including:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the material that is claimed to be infringing, with a URL.
- Your contact information.
- A statement that you have a good-faith belief that the use is not authorized.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act for the owner.
We may remove material and, in appropriate circumstances, terminate repeat infringers. If your material was removed and you believe that was a mistake, you may send a counter-notification as the DMCA allows.
Advertising, Affiliates, and Third-Party Links
The Site may display third-party advertising, including ordinary display ads and, as the Site grows, interest-based advertising. These Terms do not name a specific advertising network. Ads are not editorial endorsements. Clicking an ad takes you to a third-party site with its own terms and privacy practices.
Some articles contain affiliate links. If you buy through those links, GardenGar may earn a commission at no extra cost to you. Affiliate relationships do not determine whether we recommend a product. See our Editorial Policies.
The Site may link to retailers, manufacturers, extension services, social networks, and other resources. We do not control Linked Sites and are not responsible for their content, products, or policies. Your use of Linked Sites is at your own risk.
Product names, prices, availability, and specifications change. Confirm details with the seller before you buy.
Privacy
Our collection and use of information is described in the GardenGar Privacy Policy. By using the Site you consent to that policy. The Privacy Policy explains cookies, analytics, advertising, and your choices.
Disclaimers
THE SITE AND ALL GARDENGAR CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, GARDENGAR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ACCURACY.
WE DO NOT WARRANT THAT PLANTS WILL SURVIVE, THAT PESTS WILL BE CONTROLLED, THAT A TOOL IS SAFE FOR YOUR SITUATION, THAT A PRODUCT IS IN STOCK, OR THAT ANY RESULT DESCRIBED ON THE SITE WILL BE ACHIEVED.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IN THOSE JURISDICTIONS, OUR WARRANTIES ARE LIMITED TO THE MINIMUM PERMITTED BY LAW.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GARDENGAR AND ITS OWNERS, EDITORS, WRITERS, CONTRIBUTORS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, PLANTS, CROPS, LIVESTOCK, PETS, OR PROPERTY, ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.
THESE LIMITATIONS ARE A FUNDAMENTAL PART OF THE BASIS OF THE BARGAIN. THEY APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THEY DO NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR GROSS NEGLIGENCE OR FOR FRAUD.
Indemnification
You will defend, indemnify, and hold harmless GardenGar and its owners, editors, writers, contractors, and agents from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the Site, your User Content, your violation of these Terms, or your violation of any law or third-party right, including claims that a plant, product, or method you used after reading the Site caused harm.
Termination
We may suspend or terminate your access to the Site at any time, with or without notice, including if we believe you have violated these Terms. You may stop using the Site at any time. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive termination.
Changes to These Terms
We may revise these Terms from time to time. The “Last updated” date at the top will change when we do. The revised Terms take effect when posted on the Site unless a later date is stated. Your continued use of the Site after a revision means you accept the revised Terms. If you do not agree, stop using the Site.
We encourage you to review these Terms periodically. For material changes, we may also provide additional notice, such as a site banner or email if we have your address.
Governing Law and Disputes
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law rules. If you are a consumer, mandatory consumer-protection laws of your place of residence may still apply and are not waived.
You and GardenGar will first try to resolve any dispute informally by contacting staff@gardengar.com. If we cannot resolve it within 30 days, either party may pursue the dispute in the competent courts of Pakistan, and you consent to personal jurisdiction and venue in those courts, subject to any non-waivable rights you have as a consumer.
You may bring claims only in your individual capacity, not as a plaintiff or class member in a class, consolidated, or representative action, to the extent that waiver is permitted by law.
If you are a resident of the European Economic Area, the United Kingdom, or another jurisdiction that does not allow the choice of Pakistani law or Pakistani courts for consumer contracts, nothing in this section takes away rights you cannot waive.
20. Miscellaneous
These Terms, together with the Privacy Policy and Editorial Policies, are the entire agreement between you and GardenGar about the Site. They supersede prior understandings on that subject.
If a provision is held unenforceable, it will be modified to the minimum extent needed to make it enforceable, and the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Headings are for convenience only.
These Terms do not create a partnership, joint venture, employment, or agency relationship. There are no third-party beneficiaries except as expressly stated.
Notices to GardenGar must be sent to staff@gardengar.com. Notices to you may be posted on the Site or sent to an email you provide.
